Terms of Service

Last updated: September 2026

These Terms of Service govern your use of bookexoticwatersport.com and the booking of a rental through Exotic Watersport Rentals LLC ("we," "us," or "EWR"). By using this site or making a booking, you agree to these terms. These Terms cover the website and the booking transaction. They do NOT replace or restate the Participant Agreement, Release of All Claims, and Assumption of Risk, or the Bareboat Vessel Rental Agreement you sign separately when you book or check in — those documents specifically govern the on-water activity itself and remain fully in effect alongside these Terms.

Who can book

You must be at least 18 years old to make a booking. Our rentals themselves have their own minimum age and operator requirements, set out in the Rental Agreement you sign separately.

Booking and paying

When you book through this site, you're agreeing to pay the listed price for your selected experience, plus any applicable tax and add-ons. Payment is processed through Stripe at the time of booking, or, where we offer it, at the time you complete check-in. We reserve the right to decline or cancel a booking at our discretion, including for suspected fraud, unsafe conditions, or incomplete required information — in which case, if you were charged, you'll be refunded.

Cancelling, and getting your money back

• Cancellations made 24 hours or more before your scheduled reservation time: full refund. • Cancellations made less than 24 hours before your scheduled reservation time: 50% refund. • No-shows, or arriving significantly past your reservation time: no refund. In the event of unsafe weather, we may reschedule your reservation or issue a credit toward a future experience, at our discretion — weather-related safety decisions are made solely by EWR.

The ride itself — and what you sign separately

Renting and operating a JetCar or other watercraft carries real, inherent risk. Before you're permitted on the water, you'll be asked to sign a separate Participant Agreement, Release of All Claims, and Assumption of Risk, and, for self-operated rentals, a Bareboat Vessel Rental Agreement. Those documents — not this page — govern your assumption of risk, our limitation of liability for the activity itself, damage responsibility, and related terms. Please read them carefully; by booking through this site, you acknowledge you will be asked to sign them before your rental begins, and that we may decline to let you ride without a completed, valid signature.

Using this site fairly

You agree to provide accurate information when booking, not to use this site for any unlawful purpose, and not to attempt to interfere with, disrupt, or gain unauthorized access to any part of the booking system.

Our photos and words

The content on this site — including text, photos, and design — belongs to EWR or its licensors and may not be copied or used without our permission, other than as needed to make and manage your own booking.

What we do not promise

We work to keep this site accurate, available, and free of errors, but we don't guarantee it will always be uninterrupted, error-free, or perfectly current — pricing, availability, and details are subject to change. This site and the booking service are provided "as is."

The limit of what we are liable for

To the fullest extent permitted by law, EWR's liability arising from your use of this website or the booking service itself (as distinct from the on-water rental activity, which is separately governed by the Rental Agreement and waiver you sign) is limited to the amount you actually paid for the booking in question. To the fullest extent permitted by law, EWR is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of this website or the booking service. This section does not limit or replace the assumption-of-risk and release language in the separate waiver and rental agreement you sign, which governs the activity itself, and nothing in these Terms limits any liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless EWR and its owners, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of this website, or information you submit through it that is inaccurate or that you were not authorized to provide. This is separate from, and in addition to, the indemnification and release terms in the waiver and Rental Agreement you sign for the rental activity itself.

Events outside our control

EWR is not responsible for any failure or delay in the website, the booking service, or a scheduled rental that is caused by events outside our reasonable control, including weather, water or marina conditions, acts of nature, power or network outages, failures of third-party providers (such as our payment, hosting, email, or messaging providers), labor disputes, or government action. Where a rental cannot go ahead for such a reason, the weather and rescheduling terms above apply.

Which law applies

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Subject to the arbitration section below, any dispute arising from these Terms or your use of this site will be brought in the appropriate state or federal court located in the county where EWR principally operates, and you consent to the jurisdiction of those courts.

Disputes, arbitration, and class-action waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS HOW DISPUTES ARE RESOLVED. Except for a claim that qualifies for small-claims court, any dispute arising out of or relating to these Terms or your use of this website or the booking service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, seated in the county where EWR principally operates, rather than in court, and each of us waives the right to a trial by jury. Disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative proceeding. If this class-action waiver is found unenforceable as to a particular claim, that claim will proceed in court, but the rest of this section still applies. This section governs the website and the booking transaction; it does not modify the dispute terms in the separately signed waiver and Rental Agreement, which continue to apply to the rental activity. Nothing here prevents either party from seeking to enforce an arbitration award, or from bringing a claim that cannot by law be subject to arbitration.

If these terms change

We may update these Terms from time to time. If we make a meaningful change, we'll update the date below. Continuing to use the site after a change means you accept the update.
